1. Agreement
If you disagree with any part of these terms, please do not use our website or proceed with a booking. Specific hire agreements may add conditions (rate, kilometres, insurance package, handover point). Where there is a conflict, the WhatsApp-confirmed booking terms prevail for that trip, and these terms fill the gaps.
2. Who we are
We operate as Hola Rentals, providing self-drive rental coordination in the United States (demo). Business address and contact details published on our contact page apply for notices.
3. Booking & contract formation
- Enquiry only on the website. Submitting the enquiry form or messaging us does not, by itself, confirm availability, price, or a binding hire.
- Offer & acceptance. A contract is formed when we clearly confirm the material terms (vehicle class or exact car, dates/times, pickup/drop, price, deposit if any, and inclusions) and you accept by payment instruction, deposit, or explicit confirmation as we request.
- No walk-through of third parties. You hire from us, not from this website’s hosting provider or any map or analytics vendor.
4. Eligibility & documents
- You must hold a valid driving licence appropriate for the class of vehicle and acceptable under applicable U.S. state law. We may photograph or copy licences for verification.
- Government ID (e.g. passport or state-issued ID) may be required for hirer and, where applicable, additional drivers we approve.
- You warrant that information you provide (identity, address, contact) is accurate.
5. Handover & return
- Time and place are as agreed. Delays caused by flights, traffic, or unreachability may affect handover; we will use reasonable efforts to adapt within operational limits.
- At handover and return, we may record odometer reading, fuel level, and pre-existing damage with photos or a checklist. You must return keys, documents, accessories, and the vehicle in the condition recorded apart from fair wear.
- Late return may incur extra day charges and inconvenience fees as per the booking confirmation.
6. Use of the vehicle
- The vehicle is for lawful on-road use in the United States in line with our instructions. Unless we expressly permit otherwise, use may be restricted to a stated territory.
- Prohibited uses include racing, sub-hire, carriage of unlawful goods, overloading beyond manufacturer limits, driving under influence, and use by unapproved drivers.
- You are responsible for traffic violations, tolls, parking fines, and penalties incurred during the hire period unless we agree otherwise in writing.
7. Fuel
Fuel policy (full-to-full, half tank, etc.) is stated at booking. You agree to return fuel in line with that policy or pay refuelling charges at rates we communicate.
8. Damage, theft & insurance
- Insurance and excess (deductible) terms depend on the specific vehicle and package we confirm. Generic website wording is not a substitute for those details.
- You must report accidents, theft, or vandalism to us and to police as required by law without delay. Failure to report may void coverage and makes you liable for resulting loss.
- Tyre/rim damage, glass, underbody damage, interior damage, or loss of accessories may be charged based on assessment and supplier invoices.
9. Deposits, payments & charges
- Amounts, due dates, and payment channels are per booking confirmation. Security deposits (if taken) are held against damage, fines, fuel shortfall, or contract breach and released per our refund policy after return clearance.
- We may offset lawful amounts you owe us against deposits or card authorisations where applicable and permitted.
10. Limitation of liability
- To the maximum extent permitted by applicable law in the State of Florida, USA, we are not liable for indirect or consequential loss (including lost profits, missed flights, hotel costs) arising from hire or site use.
- Our aggregate liability for direct loss related to a single booking is limited to the hire fees actually paid by you for that booking, except where statute prohibits such a cap (e.g. death or injury caused by our negligence).
- The website is provided “as is”. We do not guarantee uninterrupted access or error-free content.
11. Force majeure
Neither party is liable for delay or failure due to events beyond reasonable control, including natural disasters, government orders, strikes, epidemics, or infrastructure failure, provided prompt notice is given where practicable.
12. Complaints
Raise issues first on the WhatsApp thread or email used for your booking so we can trace context. We aim to respond within reasonable U.S. business hours.
13. Changes to these terms
We may update this page periodically. The “Last updated” date reflects the current version. Continued use of the website after changes constitutes acceptance where law allows; existing confirmed hires remain on the terms confirmed for that trip unless we mutually agree otherwise.
14. Governing law & jurisdiction
These terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules. You agree to submit to the exclusive jurisdiction of courts located in Miami-Dade County, Florida, subject to rights you cannot waive under consumer protection statutes.
